Queens, New York — A 1-year-old boy died after a pickup truck struck him and his nanny while they were crossing a street with a stroller in Queens on Sunday morning, according to prosecutors. The driver, who allegedly ran a stop sign and had cocaine and THC in his system, is facing multiple criminal charges.
The crash occurred around 8:30 a.m. in the Murray Hill section of Queens. Prosecutors identified the driver as 57-year-old Elvin Rivera, who also had an unresolved driving while intoxicated (DWI) case stemming from an earlier incident in the Bronx.
What Happened in the Queens Crash?
According to the Queens District Attorney’s Office, Rivera was driving a white Chevrolet Silverado when he allegedly sped through a stop sign on 32nd Avenue and struck Justin Hu and his nanny, who was pushing the child in a stroller.
Emergency medical personnel rushed both victims to a nearby hospital. Justin was pronounced dead shortly after arriving, while his nanny suffered an injury to her right arm, authorities said.
Rivera remained at the scene following the collision, according to prosecutors.
Investigators are examining the circumstances surrounding the crash, including allegations that the driver was impaired and failed to obey traffic controls.
Driver Allegedly Had Cocaine and THC in His System
Prosecutors said Rivera allegedly had traces of cocaine and THC in his system and failed a field sobriety test following the collision.
Authorities also disclosed that Rivera had an open DWI case in the Bronx related to an incident in April.
The existence of the earlier case adds another significant detail to the investigation. However, the allegations in both cases must be addressed through the legal process.
Queens District Attorney Melinda Katz described the child’s death as a heartbreaking loss and said the tragedy could have been avoided.
“Tragically, innocent victims are killed every day in this county due to drugged and reckless driving, and my office will aggressively seek justice for Justin Hu and his family,” Katz said in a statement.
What Charges Does Rivera Face?
Rivera was arraigned Monday on multiple charges, including manslaughter, vehicular manslaughter, assault, operating a motor vehicle under the influence, driving while impaired, reckless driving and driving without a license.
He pleaded not guilty to the charges.
Judge Michael Katz ordered Rivera held without bail, according to the report. If convicted of the top charge, Rivera could face up to 15 years in prison.
He is scheduled to return to Queens Criminal Court on October 19. The charges are allegations, and Rivera is presumed innocent unless proven guilty in court.
Investigation and Court Proceedings Continue
The case has renewed attention on the dangers associated with impaired driving, particularly when drivers allegedly disregard traffic signals in areas used by pedestrians.
The death of a young child in a stroller has left a family facing an unimaginable loss, while the nanny’s injury adds to the consequences of the collision.
As the case moves forward, court proceedings are expected to address the allegations surrounding Rivera’s driving, the reported evidence of impairment and the circumstances that led to the fatal crash.
The next major development will be Rivera’s scheduled court appearance on October 19, when further details about the case may emerge.
