Miami, Florida — A nurse who was repeatedly struck by a patient at Jackson Memorial Hospital is seeking $5 million in a lawsuit against the hospital and the Miami-Dade Sheriff’s Office, alleging negligent security and retaliation after the incident.
The lawsuit was filed Wednesday morning following an attack in May that was captured on hospital surveillance video. The footage reportedly shows nurse Yanira Eguileor being struck multiple times by a patient identified as Wenyou Rubin before she falls to the ground.
The case has renewed concerns about healthcare worker safety and whether hospitals have adequate security measures in place to protect nurses and other staff members from violent incidents.
What Happened During the Jackson Memorial Hospital Attack?
According to the reported incident, Eguileor was working at Jackson Memorial Hospital in Miami when Rubin allegedly attacked her.
Surveillance footage shows the nurse being struck repeatedly before falling to the ground. Moments later, a security guard can be seen running toward the scene.
The lawsuit raises questions about whether sufficient security was available to respond to the situation and protect hospital employees.
Attorney Michael Pizzi, who represents Eguileor, argued that the incident highlights the need for stronger protections for nurses working in hospital settings.
“This is what happens when you don’t provide security for nurses in Jackson Memorial Hospital,” Pizzi said.
The allegations against the defendants have not been established in court, and the lawsuit will need to proceed through the legal process.
Nurse Seeks $5 Million in Lawsuit
Eguileor is seeking $5 million in damages, with the lawsuit alleging negligent security and post-injury retaliation, among other claims. The legal action names both Jackson Memorial Hospital and the Miami-Dade Sheriff’s Office as defendants.
Pizzi said his client believes the circumstances surrounding the attack raise serious concerns about the protection available to healthcare workers.
“You have a deranged violent individual who had a history of assaulting on law enforcement,” Pizzi said. “He’s just wandering around, available to assault nurses or assault patients with no security in sight, no police in sight, nobody protecting anybody.”
The attorney’s statements reflect the allegations being raised by the nurse’s legal team. Further details about the defendants’ responses to the lawsuit were not included in the information provided.
Lawsuit Also Alleges Retaliation After the Attack
Beyond the alleged security failures, Eguileor claims she faced retaliation after speaking publicly about the incident.
Pizzi said the nurse experienced workplace changes following the attack, including being transferred and losing access to the hospital’s computer system.
“She came in one day, she was transferred,” Pizzi said. “She was denied access to the computer system. And also, the hospital made public comments, slandering her, slandering her reputation, embarrassing her publicly.”
These allegations form another part of the legal dispute. The lawsuit is expected to address the claims that the hospital’s actions following the incident harmed Eguileor professionally or personally.
The hospital’s position on these allegations was not included in the available report, and the claims have not been independently established.
Nurse Says the Incident Has Been Traumatic
Eguileor said the experience has affected her deeply and that she has struggled to revisit the incident.
“I’ve been a nurse for 13 years, and what I’ve experienced since May has been very traumatic,” she said. “I never thought I would be in this position, and just nurses and staff in general need to be safe.”

Her comments highlight the personal impact that workplace violence can have on healthcare professionals, who routinely work in demanding environments while caring for patients.
The incident has also placed renewed attention on the importance of security procedures, timely responses to violent behavior and support for employees who experience assaults at work.
Nurse Wants Better Protection for Healthcare Workers
According to Pizzi, Eguileor’s primary goal is not simply financial compensation. He said she wants stronger protections to prevent similar incidents from happening to other nurses.
The case could bring greater scrutiny to security practices at the hospital and the responsibilities of the organizations named in the lawsuit. For now, the legal claims remain allegations, and the case will determine how the parties address the disputed issues.
Eguileor’s account underscores the concerns healthcare workers may face when violence occurs in a place where they are expected to provide care and maintain patient safety.
