Post-Conviction Relief Denied in Joshua Christon Case Over Filing Technicality

OKLAHOMA CITY — A new effort to free Joshua Christon from prison has hit another setback, after a post-conviction relief motion filed by the Oklahoma Innocence Project was dismissed—reportedly due to exceeding a page limit.

“They went over 20 pages of the required limit of filing a brief,” explained Mareo Johnson, a community advocate and activist.

The motion included evidence allegedly implicating Christon’s co-defendant, Winford McKissick. According to J. Carter of the Black Lawyers Podcast, McKissick owned a gun that matched the bullets found on the victim’s body and at the crime scene. That weapon was reportedly discovered in McKissick’s office—and Carter says authorities have had this information all along.

She also noted that a sticky note surfaced after an April petition, appearing to indicate someone knowingly failed to turn over critical evidence.

“Someone left a note, literally indicating that they had not turned the file over,” Carter said. She emphasized that the judge has not yet reviewed the evidence. “At a minimum, this evidence needs to be reviewed, and the judge needs to do the right thing and allow them to resubmit it based on whatever page limit they’re claiming.”

Johnson said the Oklahoma Innocence Project is now asking the judge to reconsider the motion and allow them to respond to the District Attorney’s reasoning for the dismissal.

FOX 25 reached out to Christon’s attorney, Andrea Miller, to see if a timeline has been set for the judge’s decision. As of now, there has been no response.
