Following Monday’s mass shooting in New York City, concerns have resurfaced about individuals with serious mental health issues having access to firearms. In Colorado, more people are turning to the state’s Red Flag Law, officially known as Extreme Risk Protection Orders (ERPOs), to help prevent gun violence.
The law allows courts to temporarily remove firearms from individuals who are deemed a danger to themselves or others. Though early adoption was low—only 96 petitions were filed in the first year (2020), with 64 granted—state officials say use of the law is steadily increasing.
“In Colorado, as we build more familiarity and educate law enforcement, we’re seeing an increase in usage,” said Attorney General Phil Weiser. “We expect that to continue.”
In 2023, 168 petitions were filed, and 125 were approved. Data for 2025 is not yet available, but Weiser’s office reviews and publicly reports on every case. Most ERPOs start as temporary two-week orders, which can be extended if the court finds ongoing risk.
Weiser emphasized that while ERPOs are a vital tool, they’re also carefully balanced. “This law has regular opportunities for check-ins. The order can last up to a year, but it must be reissued based on justification,” he said.
However, not everyone agrees with the law’s approach. Rocky Mountain Gun Owners (RMGO), a vocal opponent, argues the law violates due process.
“Red Flag Laws fly in the face of the principles this country was founded on,” said RMGO Executive Director Ian Escalante in a statement. “They shred due process and are antithetical to the idea of ‘innocent until proven guilty.’”
Despite opposition, Weiser maintains that the law plays a critical role in preventing tragedies. “Too many people in Colorado die from suicide or from being shot by someone who should never have had a gun,” he said. “This law is one of the most important gun violence prevention measures we have.”
