Starting August 6, new legislation in Colorado will go into effect to help reduce the cost of health care and prescription drugs while protecting access for underserved communities.
Democratic lawmakers say the measures will strengthen the federal 340B Drug Pricing Program, which allows participating hospitals, clinics, and pharmacies to purchase outpatient medications at a discount. The new laws will prevent drug manufacturers from imposing restrictions on facilities that rely on this program.
“This law helps ensure that Coloradans, especially those in rural and underserved communities, receive the prescription drugs they need to lead healthy lives,” said Representative Matthew Martinez. “It bars pharmaceutical companies from placing limits on local pharmacies, clinics, and safety-net providers that use the 340B program.”
The legislation will also allow for the safe donation and redistribution of certain unused medications. Lawmakers say this will make it easier for patients to adjust dosages or medication frequency when needed.
Hospitals will now be required to include detailed information in their annual reports, including how they use the savings generated through the 340B program.
According to the General Assembly Democrats, the 340B program mandates that drug manufacturers offering products through Medicaid must provide discounted outpatient drugs to eligible facilities. In Colorado, about 68 hospitals and 20 federally qualified health centers participate in the program.
“Colorado families are counting on us to put their health and safety first,” said Senator Michaelson Jenet. “This new law will ensure that all Coloradans, especially those who rely on rural hospitals, pharmacies, and providers, don’t lose access to the services they depend on to stay safe and healthy.”
