An Oklahoma County judge is expected to decide whether the man charged with killing an Oklahoma County deputy is now mentally competent to stand trial.
In 2022, deputies were attempting to serve eviction papers at the home of Benjamin Plank when he allegedly opened fire, fatally shooting one of the officers.
Plank was previously found incompetent to stand trial and was ordered to undergo mental health treatment.
A hearing is scheduled for 10 a.m. to determine if the state has exhausted all available treatment options and whether Plank’s mental condition has improved enough for court proceedings to move forward.
