AURORA, Colo. — Congressman Jason Crow is accusing Immigration and Customs Enforcement (ICE) of obstructing congressional oversight after he was denied entry to an ICE detention facility in Aurora on Sunday.
Crow, a Democrat representing Colorado’s 6th Congressional District, said the refusal violates a law that allows members of Congress to make unannounced visits to such facilities. He cited the Consolidated Appropriations Act of 2020, which he says grants him legal authority to conduct surprise inspections to promote transparency and accountability.
“Why does the administration want to impede congressional oversight?” Crow asked. “Why enforce a seven-day notice requirement for the first time ever? What are they trying to hide?”
ICE officials said they informed Crow on July 15 that a visit was not possible at this time. In a statement, ICE emphasized that congressional visits must comply with a mandatory seven-day notice to ensure safety, operational security, and proper coordination.
The Department of Homeland Security also defended the requirement, stating that the notice period is necessary to protect the President’s constitutional authority to oversee executive functions. DHS added that assaults on ICE personnel have surged by 830%, making coordination even more critical.
Crow pushed back, saying, “They’re wrong. Executive authority cannot override a law passed by Congress. Congress, as the Article I branch, creates the law of the land. The President must follow those laws—not ignore them by executive order or regulation.”
ICE said the policy ensures the safety of staff and detainees, citing detention standards that include visitor screening and scheduled tours. Crow, however, argued that requiring prior notice undermines the very purpose of oversight and creates opportunities to conceal misconduct.
